1. ABOUT THE VITAL MANTRA
The Vital Mantra is a wellness and personal-development platform providing access to professional services and programmes relating to emotional well-being, counselling, psychotherapy, emotional intelligence, life coaching, relationship support, personal development, training, workshops, assessments and related areas of growth. Depending on the service selected, services may be provided by The Vital Mantra, its practitioners, counsellors, coaches, trainers, facilitators, consultants or other professionals associated with the platform. The specific nature, scope, methodology, qualifications and limitations of each service may vary and will be communicated or made available before or at the time of booking, wherever applicable. Where a service involves regulated professional practice, it will be provided by an appropriately qualified professional in accordance with applicable law and professional requirements.
2. NATURE AND LIMITATIONS OF OUR SERVICES
The Vital Mantra provides professional and educational support intended to promote emotional well-being, self-awareness, personal development, coping skills, relationships, emotional intelligence and related areas of growth. Unless expressly stated otherwise, information provided through the website, articles, videos, social media, workshops or other educational materials is provided for general informational and educational purposes and does not constitute personalised medical, psychiatric, legal, financial or other professional advice. Counselling, psychotherapy, coaching, training and wellness services are not a guarantee of any particular personal, emotional, psychological, relationship, academic, professional or other outcome. Individual progress and outcomes vary depending on individual circumstances, participation, engagement and numerous factors beyond the control of The Vital Mantra or the relevant professional. Nothing on this website or in any service description should be interpreted as a promise or guarantee of a specific result. Where a service is not intended to constitute medical treatment, psychiatric treatment or emergency care, this will be communicated as applicable.
3. EMERGENCIES AND CRISIS SITUATIONS
The Vital Mantra is not an emergency or crisis-response service. Website enquiries, email, messaging, appointment systems and scheduled sessions should not be relied upon where immediate assistance is required. If you believe that you or another person is at immediate risk of serious harm, including risk of suicide, self-harm, violence, or a medical or psychiatric emergency, please immediately contact the appropriate local emergency service, go to the nearest hospital or emergency department, or contact an appropriately qualified emergency or healthcare professional. In India, individuals seeking immediate mental-health support may also contact the Government of India's Tele-MANAS service at 14416 or 1800-89-14416, subject to the availability and terms of that service. The Vital Mantra cannot guarantee immediate availability, emergency response or crisis intervention through its website, practitioners, messaging systems, appointment services or other communication channels.
4. PROFESSIONAL RELATIONSHIP
Booking or using a service does not automatically create an unlimited or continuing professional relationship beyond the specific service or engagement agreed upon. The nature and scope of the professional relationship will depend on the service selected and the professional providing the service. A practitioner may determine that a particular service is not appropriate for an individual's needs and may recommend referral to another qualified professional, healthcare provider or specialised service where appropriate. The Vital Mantra and/or the relevant practitioner reserves the right to decline, discontinue, modify or refer a service where there are reasonable professional, ethical, safety, scheduling, operational or other legitimate grounds for doing so, subject to applicable law and professional obligations.
5. ELIGIBILITY AND ACCOUNTS
Users must provide accurate, complete and current information when creating an account, submitting an enquiry or booking or purchasing a service. You are responsible for maintaining the confidentiality of your account credentials and for activities undertaken through your account. You must not create an account using another person's identity or provide false, misleading or fraudulent information. Where a service is provided to a minor, the parent, legal guardian or other legally authorised person may be required to provide consent and complete applicable booking, consent or documentation requirements. The Vital Mantra may request additional information or documentation where reasonably necessary for safeguarding, service delivery, verification or legal compliance.
6. BOOKINGS AND APPOINTMENTS
Appointments are subject to practitioner availability. A booking shall be considered confirmed only after the applicable booking process has been completed and, where required, payment has been successfully received or confirmation has otherwise been issued by The Vital Mantra. The Vital Mantra reserves the right to change an appointment time where reasonably necessary due to practitioner availability, illness, technical issues, operational circumstances or events beyond reasonable control. Where The Vital Mantra needs to cancel or reschedule an appointment, reasonable efforts will be made to offer an alternative appointment or applicable remedy in accordance with the relevant booking terms and applicable law.
7. CLIENT ATTENDANCE AND PUNCTUALITY
Clients are expected to attend appointments at the scheduled time. For online sessions, clients should join using the relevant link or platform sufficiently in advance to ensure that technical issues do not unnecessarily reduce the session time. If a client arrives late, the practitioner may be unable to extend the session beyond the originally scheduled end time. Where the applicable booking or cancellation policy permits, the full or applicable session fee may remain payable where a client arrives late, cancels without the required notice or fails to attend.
8. CANCELLATION AND RESCHEDULING
Clients should provide reasonable advance notice when cancelling or requesting to reschedule an appointment. The cancellation, rescheduling and no-show terms applicable to a particular service will be displayed or communicated during the booking process and shall form part of the agreement for that service. Different services, packages, workshops or programmes may have different cancellation conditions. Where a specific cancellation policy has been communicated at the time of booking, that policy will apply, subject to applicable law and any mandatory consumer rights. The Vital Mantra reserves the right to restrict future bookings where repeated cancellations, no-shows, abusive conduct or misuse of the appointment system materially affects service delivery.
9. FEES AND PAYMENTS
Applicable fees will be communicated or displayed before payment. Prices may vary depending on the practitioner, service, duration, programme, package or other applicable factors. Payments may be processed through third-party payment service providers. By making a payment, you confirm that the payment information provided by you is accurate and that you are authorised to use the selected payment method. Where applicable, taxes and other legally required charges will be disclosed in accordance with applicable law. The Vital Mantra reserves the right to correct pricing or description errors discovered before an order or booking is confirmed, subject to applicable law.
10. REFUNDS
Refund eligibility will depend on the nature of the service purchased and the cancellation or refund terms communicated before payment. Services that have already been fully provided may generally not be refundable, subject always to applicable law and any mandatory consumer rights or remedies. For prepaid packages, workshops, courses or programmes, any applicable refund, cancellation, transfer or expiry conditions will be communicated at the time of purchase. Nothing in these Terms and Conditions is intended to exclude, restrict or waive any refund, remedy, consumer right or statutory protection that cannot lawfully be excluded or restricted. Where a refund is approved, it may be processed through the original payment method or another reasonable method, subject to applicable payment-provider procedures and processing timelines.
11. ONLINE SERVICES AND TECHNICAL REQUIREMENTS
For online sessions, clients are responsible for having: • A suitable device; • A reasonably stable internet connection; • Appropriate audio/video facilities where required; • A private and reasonably confidential environment; and • Access to the relevant communication platform. The Vital Mantra is not responsible for interruptions, delays or reduced session quality caused by the client's internet connection, device, software, electricity supply, third-party platform or other circumstances outside its reasonable control. Where a technical problem materially prevents a session from being conducted, reasonable efforts may be made to reschedule the session in accordance with the applicable booking policy.
12. PRIVACY AND CONFIDENTIALITY
The Vital Mantra respects the privacy of its clients and handles personal information in accordance with its applicable Privacy Policy and applicable data-protection and privacy laws. Information shared during professional sessions is treated as confidential, subject to applicable legal, professional and ethical requirements. Where applicable, confidentiality may be limited where disclosure is required or permitted by law or is reasonably necessary in circumstances such as serious and imminent safety concerns, safeguarding concerns, abuse or neglect, court or governmental orders, professional consultation, or other legally recognised exceptions. Where the Mental Healthcare Act, 2017 or other applicable professional or healthcare legislation applies to a service, the confidentiality rights and obligations applicable under such law shall also apply. Only information reasonably necessary for the relevant lawful purpose should be disclosed where such disclosure is permitted or required by law. The exact confidentiality obligations may vary according to the nature of the service, the professional involved and applicable law. Clients should review the separate Privacy Policy for information regarding the collection, use, storage, disclosure, retention and protection of personal information and their applicable rights.
13. RECORDING OF SESSIONS
Clients must not audio-record, video-record, photograph, screenshot, livestream or otherwise record a counselling, psychotherapy, coaching, consultation, workshop or group session without the prior express consent of the relevant practitioner and, where applicable, other participants. The Vital Mantra and its practitioners will not record sessions unless there is a legitimate purpose and appropriate notice, consent or other lawful basis as required under applicable law and professional requirements. Where a session or event is recorded with appropriate authorisation, applicable terms regarding its purpose, use, storage, retention and access will be communicated separately.
14. CONFIDENTIALITY IN GROUP PROGRAMMES
Workshops, group counselling, training sessions and group programmes may involve participants sharing personal experiences or other sensitive information. While The Vital Mantra will take reasonable measures to promote confidentiality, it cannot guarantee that another participant will maintain confidentiality. Participants must respect the privacy of other participants and must not disclose, photograph, record, reproduce, publish or distribute another participant's personal information, statements, images or experiences without appropriate permission or lawful authority.
15. CLIENT RESPONSIBILITY
Clients are responsible for providing information that is reasonably accurate and relevant to the service being provided. Clients are encouraged to communicate important circumstances that may affect their participation, treatment, support or safety. Clients remain responsible for their own decisions and actions outside sessions. Professional recommendations are intended to support the client's well-being and decision-making and do not remove the client's responsibility for decisions made independently. Clients should seek appropriate medical, psychiatric, emergency or other professional assistance where circumstances require services beyond the scope of the service being provided by The Vital Mantra.
16. ASSESSMENTS, QUESTIONNAIRES AND REPORTS
Where psychological, behavioural, psychometric, emotional-intelligence or other assessment tools are used, the results are intended to support professional understanding, guidance, development or decision-making within the applicable scope of the assessment. Assessment results should be interpreted in the context of the individual's circumstances and should not automatically be treated as a definitive diagnosis, prediction or determination of future behaviour, performance or outcome unless specifically established through an appropriate professional process. Reports and assessment results are intended for the purpose for which they were prepared and should not be altered, misrepresented or distributed without appropriate permission or lawful authority. No assessment or questionnaire should be relied upon as a substitute for a professional diagnosis where a formal diagnosis is required.
17. WORKSHOPS, TRAINING AND EDUCATIONAL PROGRAMMES
Workshops, seminars, courses, training programmes and educational content may be designed for general learning, awareness and development. Participation does not guarantee a particular academic, professional, behavioural, emotional or personal outcome. Unless expressly stated otherwise, participation in a workshop or training programme does not constitute individual psychotherapy, medical treatment or emergency support. Programme schedules, facilitators, content, format and delivery methods may be reasonably modified where required due to operational, professional, safety, technical or other legitimate circumstances.
18. ACCEPTABLE USE OF THE WEBSITE
You agree not to: • Use the website for unlawful or fraudulent purposes; • Impersonate another person; • Provide false or misleading information; • Attempt to gain unauthorised access to accounts, systems or data; • Interfere with the security or operation of the website; • Introduce malware, viruses or other harmful material; • Harass, threaten, abuse or intimidate practitioners, staff, clients or other users; • Copy, reproduce or commercially exploit website content without permission; • Upload content that infringes another person's rights; • Use the website to distribute spam or unsolicited commercial communications; or • Use the website in any manner that violates applicable law. The Vital Mantra may suspend or restrict access where reasonably necessary to protect users, professionals, systems, intellectual property or the legitimate interests of the platform, subject to applicable law.
19. INTELLECTUAL PROPERTY
All content appearing on the website, including The Vital Mantra name and branding, logo, text, graphics, photographs, videos, designs, worksheets, presentations, articles, educational materials, programme materials and other content, is owned by or licensed to The Vital Mantra unless otherwise stated. You may access and use such content solely for personal and lawful purposes. You must not reproduce, copy, modify, publish, distribute, transmit, sell, licence, create derivative works from or commercially exploit such content without prior written permission, except where permitted by applicable law. Nothing in these Terms and Conditions transfers any intellectual property rights to you.
20. USER-GENERATED CONTENT AND FEEDBACK
Where users are permitted to submit reviews, testimonials, comments, feedback or other content, the user confirms that the content is truthful to the best of their knowledge and does not knowingly infringe the rights of another person. Users must not disclose another person's confidential or personal information without appropriate authority. The Vital Mantra may moderate, remove or decline to publish content that is unlawful, misleading, abusive, defamatory, inappropriate, confidential, infringing or otherwise inconsistent with these Terms and Conditions or applicable law. Any use of a client testimonial or identifiable client experience for marketing, promotional or public-relations purposes should be based on appropriate consent and handled in accordance with applicable law.
21. WEBSITE INFORMATION AND THIRD-PARTY SERVICES
The Vital Mantra aims to keep website information accurate and useful but does not warrant that every item of information will always be complete, current or error-free. The website may contain links to third-party websites, applications, payment gateways, communication platforms or other services. Third-party services are governed by their own terms and privacy policies. The Vital Mantra does not control third-party services and is not responsible for their independent operation, content, availability, security or policies, except to the extent liability cannot lawfully be excluded or limited. The inclusion of a third-party link does not necessarily constitute an endorsement, recommendation or guarantee of that third party.
22. AVAILABILITY AND FORCE MAJEURE
The Vital Mantra will make reasonable efforts to maintain website and service availability. However, continuous, uninterrupted or error-free access cannot be guaranteed. Subject to applicable law, The Vital Mantra shall not be responsible for delays, interruptions or inability to provide services caused by circumstances reasonably beyond its control, including natural disasters, serious illness, technical failures, internet or telecommunications failures, power failures, governmental restrictions, public emergencies, cyber incidents, third-party service failures or other circumstances constituting force majeure. Where reasonably practicable, The Vital Mantra will take appropriate steps to minimise the impact of such circumstances and restore services.
23. PROFESSIONAL DISCRETION AND REFERRAL
The Vital Mantra or an individual practitioner may determine that a particular service is not appropriate for a client's needs, circumstances or level of support required. Where reasonably appropriate, the client may be encouraged or referred to another qualified professional, healthcare provider, emergency service or specialised service. Such referral is intended to support appropriate care and does not constitute a guarantee regarding the services, availability or outcomes provided by the referred third party. Where a service is outside the professional's scope of practice, the practitioner may decline to provide that service or recommend an appropriate referral.
24. LIMITATION OF LIABILITY
Nothing in these Terms and Conditions excludes or limits any liability, right or remedy that cannot lawfully be excluded or limited under applicable law. Subject to the foregoing, and to the maximum extent permitted by applicable law, The Vital Mantra shall not be responsible for indirect, incidental, consequential or unforeseeable losses arising from a client's use of the website or services. Nothing in these Terms and Conditions is intended to exclude or limit liability for fraud, wilful misconduct, gross negligence where such exclusion is not permitted, or any other liability that cannot legally be excluded or limited. Nothing in these Terms and Conditions shall be interpreted as excluding or restricting any mandatory consumer right or statutory remedy available under applicable law.
25. INDEMNITY
To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, costs or expenses arising directly from: • Your unlawful use of the website; • Your material breach of these Terms and Conditions; • Fraudulent or intentionally wrongful conduct by you; • Misuse of the services; or • Your violation of another person's rights. This provision does not require a client to indemnify The Vital Mantra for liability caused by The Vital Mantra's own unlawful conduct or for liability that cannot legally be transferred to the client.
26. SUSPENSION OR TERMINATION
The Vital Mantra may suspend, restrict or terminate access to an account or service where reasonably necessary due to: • Material breach of these Terms and Conditions; • Fraudulent or unlawful activity; • Abuse, harassment or threats; • Misuse of the website or services; • Security concerns; • Repeated non-compliance with booking or payment requirements; or • Other legitimate operational, professional, ethical, safeguarding or legal reasons. Where reasonably practicable, The Vital Mantra may provide notice or an opportunity to remedy a breach before termination, except where immediate action is reasonably necessary. Termination or suspension will not affect rights or obligations that accrued before termination.
27. CHANGES TO SERVICES AND TERMS
The Vital Mantra may modify, add, suspend or discontinue website features, services, programmes or content from time to time. These Terms and Conditions may also be updated to reflect changes in services, technology, professional practices, business operations or applicable law. The latest version and effective date will be published on this page. Where legally required, reasonable notice will be provided for material changes. Continued use of the website or services after revised Terms and Conditions become effective constitutes acceptance of the revised Terms and Conditions to the extent permitted by applicable law.
28. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India, subject to applicable consumer-protection, privacy, mental-health, professional and other mandatory legal rights and requirements. Nothing in these Terms and Conditions is intended to deprive a consumer of any mandatory right or remedy available under applicable law.
29. DISPUTE RESOLUTION
The Vital Mantra encourages clients to first contact us directly so that concerns or complaints can be reviewed and, where reasonably possible, resolved amicably. Where a dispute cannot be resolved informally, the parties may pursue the remedies available under applicable Indian law. Nothing in this provision prevents a consumer from exercising a statutory right to approach an appropriate authority, regulator, consumer commission, court or other forum where such right is available under law. Nothing in this section prevents either party from seeking urgent or interim relief from a court or other competent authority where such relief is legally available.
30. GRIEVANCE AND CUSTOMER SUPPORT
Questions, complaints or concerns relating to bookings, payments, services or these Terms and Conditions may be submitted using the contact details provided on the Contact Us page. Where applicable, The Vital Mantra will maintain and communicate the details of the person responsible for handling grievances in accordance with applicable law. For privacy or personal-data related grievances, users may also use the grievance mechanism described in the applicable Privacy Policy.
31. SEVERABILITY
If any provision of these Terms and Conditions is determined to be invalid, unlawful or unenforceable by a competent authority, that provision shall, where legally permissible, be interpreted or modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall continue to apply to the extent permitted by law.
32. NO WAIVER
Failure by The Vital Mantra to enforce any provision of these Terms and Conditions immediately shall not constitute a waiver of its right to enforce that provision subsequently. Any waiver must be made expressly and shall apply only to the specific circumstances for which it is given.
33. ENTIRE AGREEMENT
These Terms and Conditions, together with the Privacy Policy, applicable Cancellation and Refund Policy and any service-specific terms communicated at the time of booking or purchase, constitute the applicable agreement between the user and The Vital Mantra concerning use of the relevant website or service, subject to mandatory rights under applicable law. If a service-specific term conflicts with these Terms and Conditions, the service-specific term shall apply to that service to the extent of the conflict, unless applicable law requires otherwise.
34. ACCEPTANCE
By creating an account, submitting a booking, making a payment, participating in a session, workshop or programme, or otherwise using The Vital Mantra website or services, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by the terms applicable to your use of the website or services, subject to rights and remedies that cannot lawfully be waived.
